Habanos S.A., Cuba’s premium cigar exporter, is increasingly leaning on machine-made cigars produced at the Internacional Cubana de Tabacos (ICT) factory in Havana, according to The Havana Times. Though lacking the prestige of hand-rolled cigars, these products generated $38 million in revenue in 2024, part of Habanos S.A.’s record $827 million annual earnings.

The factory, a joint venture with Spain’s Tabacalera, runs 64 machines and operates three shifts daily, producing up to 800,000 cigars a day to meet global demand under the Cohiba, Partagás, Montecristo, and Romeo y Julieta brands.

Industry insiders acknowledge that Habanos’ luxury clientele won’t abandon premium hand-rolled cigars. Yet for now, machine-made alternatives are helping cushion the blow from Cuba’s deepening agricultural and infrastructure crisis, according to the newspaper.

General Cigar Co. filed a notice of appeal in General Cigar Company, Inc. v. Empresa Cubana del Tabaco, D.B.A. Cubatabaco, last week, a lawsuit over the trademark of the Cohiba name in the U.S. that began in 1997. The May decision by Judge Leonie Brinkema would allow the TTAB to cancel General’s U.S. Cohiba trademarks, according to Halfwheel.

“We are of course disappointed by this decision, but we and our advisors will now study the ruling closely and of course consider the opportunity to appeal to the US Court of Appeals for the Fourth Circuit,” said Régis Broersma, chief commercial officer of STG, owner of General Cigar Co., in a press release following last month’s ruling. “Our federal trademark registrations which are the subject of the dispute, would remain valid and enforceable during a pending appeal. We expect the long dispute to continue before the courts.”

Broersma indicated General would file an appeal, which it now has. The appeal is listed as a restricted entry in the U.S. Court of Appeals for the Fourth Circuit’s electronic filing system. No product changes for either company are expected anytime soon.

Scandinavian Tobacco Group’s (STG) General Cigar Co. has appealed the Trademark Trial and Appeal Board’s (TTAB) December 2022 cancelation of the Cohiba trademark registration in the United States.

“By initiating this lawsuit to appeal the TTAB decision and to obtain a declaration of its rights, General Cigar expects the court will ultimately rule it has exclusive U.S. rights to the Cohiba marks,” Regis Broersma, president of STG’s North America and Rest of the World division was quoted as saying by Cigar Journal.

STG and Empresa Cubana del Tabaco (Cubatabaco) have fought over the U.S. rights to the Cohiba trademark since 1997. The TTAB sided in favor of the Cuban cigar conglomerate in its claim on the name, saying that General Cigar Co.’s registrations on the Cohiba trademark are to be canceled due to a violation of an international agreement that dates back to 1929.

However, General Cigar believes the TTAB decision is improperly based on the re-litigation of a claim that was decided in General Cigar’s favor by a U.S. Court of Appeals for the 2nd Circuit more than a decade ago.

In February 2005, the 2nd Circuit Court of Appeals in New York ruled unanimously in favor of General Cigar.

While there are more trademark conflicts between Cuban and American cigar companies, Cohiba is a unique case due to both its prominence on the global stage and its creation by the state-run tobacco company after the Cuban Revolution, whereas other brands with Cuban roots that General Cigar Co. owns, such as Partagas, Hoyo de Monterrey and La Gloria Cubana, were assumed by the Cuban government in 1959.

While the lawsuit moves forward, General Cigar said it will continue to manufacture, market, sell and enforce its Cohiba trademarks.
