{"id":163356,"date":"2025-03-18T13:34:42","date_gmt":"2025-03-18T13:34:42","guid":{"rendered":"https:\/\/tobaccoreporter.com\/?p=163356"},"modified":"2025-03-18T13:34:44","modified_gmt":"2025-03-18T13:34:44","slug":"bill-aims-to-exempt-premium-cigars-from-fda-control","status":"publish","type":"post","link":"https:\/\/tobaccoreporter.com\/2025\/03\/18\/bill-aims-to-exempt-premium-cigars-from-fda-control\/","title":{"rendered":"Bill Aims to Exempt Premium Cigars from FDA Control"},"content":{"rendered":"\n<p>A bill introduced on the Congressional House floor Friday would exclude cigars from the broader \u201ctobacco product\u201d categorization defined by Federal Food, Drug and Cosmetic Act, thereby exempting premium, handmade cigars from FDA regulation.<\/p>\n\n\n\n<p>Under the new bill, premium cigars would follow the same definition Judge Amit P. Mehta recently established in the cigar industry\u2019s lawsuit battle with the FDA. This definition of a premium cigar would include the following parameters:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Wrapped in whole tobacco leaf \u00a0<\/li>\n\n\n\n<li>Contains a 100% leaf tobacco binder \u00a0<\/li>\n\n\n\n<li>Contains at least 50% long-filler tobacco<\/li>\n\n\n\n<li>Is handmade or hand-rolled<\/li>\n\n\n\n<li>Has no filter, nontobacco tip,\u00a0or nontobacco mouthpiece \u00a0<\/li>\n\n\n\n<li>Does not have a characterizing flavor other than tobacco \u00a0<\/li>\n\n\n\n<li>Contains only tobacco, water,\u00a0and vegetable gum with no other ingredients or additives \u00a0<\/li>\n\n\n\n<li>Weighs more than six\u00a0pounds per 1,000 units.<\/li>\n<\/ul>\n\n\n\n<p>The Federal Food, Drug and Cosmetic Act essentially authorizes the FDA to regulate food, drugs, medical devices, and cosmetics. These broad categories ultimately include \u201ctobacco products,\u201d which are broadly defined in the Act as \u201cany product made or derived from tobacco, or containing nicotine from any source, that is intended for human consumption\u2026\u201d H.R. 2111, being brought forth by Rep. Byron Donald, would amend this portion of the Act.<\/p>\n\n\n\n<p>\u201cBack in January, the cigar industry notched yet another big victory against the FDA in the longstanding battle over regulating cigars,\u201d Garrett Rutledge wrote for <em>Cigar Aficionado<\/em>. \u201cThe United States Court of Appeals for the District of Columbia shot down the FDA\u2019s appeal, which sought to overturn the 2023 ruling by Judge Mehta that ruled against the FDA\u2019s application of the Deeming Rule on the cigar industry. The ruling spared the industry from a number of draconian regulations, but it did not fully remove the FDA\u2019s ability to regulate premium cigars.
